Exclusive and Non-Exclusive Licenses Explained

What is an Exclusive License?

As the exclusive license holder of a music track ("recording"), only you will be allowed to use the recording (including all variations of the recording) making it unique for your game. Upon purchasing the exclusive license of a recording it will no longer be available for others to license in any form. The exclusive license grants use of the recording in one game. Additional licenses will have to be purchased if you wish to use the recording in multiple games.

Exclusive License Terms:

• Exclusive Rights Owner is granted use of the recording in one game
• Exclusive Rights Owner may not resell or distribute the recording separately
• Exclusive Rights Owner may use the recording for own promotional use (e.g. in videos)
• Exclusive Rights Owner must give full credit to Imphenzia Soundtrack for the recording
• Imphenzia Soundtrack may no longer lease or sell the recording
• Imphenzia Soundtrack may make the recording available in reduced quality for promotional purposes

What is a Non-Exclusive License?

As the non-exclusive license holder of a music track ("recording"), you and other non-exclusive license holders will be allowed to use the specific variation of a recording. The non-exclusive license grants use of the recording in one game. Additional licenses will have to be purchased if you wish to use the recording in multiple games.

Non-Exclusive License Terms:

• Non-exclusive Rights Owner is granted use of the recording in one game
• Non-exclusive Rights Owner may not resell or distribute the recording separately
• Non-exclusive Rights Owner must make resonable effort to protect the recording to avoid the recording being extracted and/or distributed separately (e.g. embed audio files in a library or archive file)
• Non-exclusive Rights Owner may use the recording for own promotional use (e.g. in videos)
• Non-exclusive Rights Owner must give full credit to Imphenzia Soundtrack for the recording
• Imphenzia Soundtrack is the Exclusive Rights Owner and may continue to lease and sell the recording

Why are different or no licensing forms available for different tracks?

When new tracks are released, they will for 30 days only be available as an Exclusive license in order to give game makers a resonable chance to obtain exclusive music for their game. If nobody has obtained the Exclusive license of a track within 30 days it will also become available in the form of Non-Exclusive licensing. Tracks that are available in both licensing forms will remains so until either:

• Someone purchases the Non-Exclusive license of a track variation. In this case Exclusive licensing will no longer be available for the track.
• Someone purchases the Exclusive license of a track. In this case no licensing form will be available for the track except for additional bulk licenses for the Exclusive rights holder.

Tracks that are not available in any form of licensing remain on the web site in reduced quality for promotional purposes. If a track is not available for licensing and you find it suitable for your game, please use the button next to the track to request a similar track for your game.
